I. TEACHING AND SUPERVISION SERVICE
Registration for services supervised by one of the CPO instructors implies the pure and simple acceptance of these general conditions by the subscriber, who undertakes to inform, in the event of registration of a group or several people , each of the participants of all the terms and these conditions.

ART. 1 – SPEAKERS
Canyoning Pyrénées Orentales offers supervision and teaching of sports disciplines in the great outdoors. All the activities offered are supervised and provided by state-qualified guides (BEES / DEJEPS / BPJEPS) in their respective disciplines and meeting their legislative obligations (URSSAF, RCP, DDCSPP declaration, professional cards).

ART. 2 – REGISTRATION AND RESERVATION
All our activities are done by reservation, either online by filling out the reservation form or by contacting CPO directly by email at canyoning.po@gmail.com, by phone at 06 83 20 24 16 .
All reservations will be confirmed and effective upon receipt of deposit.


ART. 3 – PRICE
The are presented on the site http://www.canyoning-pyrenees-orientales.com/  in € including VAT.
Prices include: organization, supervision provided by a state-qualified guide and the loan of technical and safety equipment necessary for the practice of the chosen activity.
All our equipment is inspected, checked, cleaned, disinfected and up to the latest standards.

ART. 4 – METHOD OF PAYMENT
For supervision services, the payment must be addressed (worded) to the attention of the instructor, in his own name. This mention will be stipulated when booking.

For the activities offered by our partners, payment will be made according to the T&Cs of the service provider. 
Means of payment accepted: cheque, holiday voucher, bank transfer, bank card (secure payment by internet only) or cash.
We do not cash by credit card at the place of activity.

ART. 5 – CONDITIONS OF PARTICIPATION
Our activities are open to everyone; however, depending on the activities and routes, certain conditions must be taken into account (age limit, knowing how to swim and immerse yourself, technical level, physical condition, etc.). The routes, times and distances are given for information only. They are part of the current services provided by us, but can in no way be used as a contractual basis.

The images on the site www.canyoning-pyrenees-orientales.com  are as faithful as possible but may differ with the service rendered. (season, weather, water quality...). The photographs and illustrations do not constitute a contractual document.
Minors must be accompanied by their legal guardians during the stay and the activity.
CPO does not have the means to check the level of sports practice of its customers. It is therefore up to each participant to have assessed his physical form according to the activities he wishes to carry out. To know these conditions, please refer to the technical sheets of the activities. 
You must not be subject to any medical contraindication to the practice of the chosen activity.
IMPORTANT: You are not the subject of a medical contraindication but you are dependent on special medical care or treatment (asthma, diabetes, etc.) or your state of health requires special attention (fragile joint, problem back, obligatory wearing of glasses, etc.), you must imperatively inform the instructor before the start of the activity and provide the appropriate emergency medication, according to medical recommendations.

ART. 6 – INSURANCE AND LIABILITY
Each instructor/professional is insured for Professional Civil Liability for their own activities and for the costs incurred by a possible rescue operation.
We strongly advise each participant to be covered by civil liability insurance and/or an individual accident with the insurance of their choice for the practice of white water and/or mountain sports. Indeed, we cannot replace the individual civil liability of each participant.
CPO cannot be held liable for activities booked with other service providers.
In the event of a bodily accident, the responsibility  of the instructor involved is released as soon as the victim is taken care of by the competent rescue organizations, and any hospital follow-up will be the responsibility of the personal insurance of the injured party. .
The practice of outdoor activities takes place in a specific environment called "at risk".
Each participant is aware, given the specific nature of the activities offered, that he may run certain risks due in particular to remoteness, isolation and the specific nature of the environment.  assumes in full knowledge of the facts and must comply with the rules of prudence and follow the advice given by professionals.
The participant/client is responsible for the equipment loaned to him for the activity. The professional cannot be held responsible for any damage that may be caused by the equipment made available.
In the event of theft or damage to the loaned equipment, the participant/customer may be asked for compensation for wear and tear or a full refund of the equipment.
The instructors cannot be held responsible for the loss, theft (including in vehicles) or the breakage of objects (eg glasses, cameras, etc.) that practitioners could take with them during the activity and which may provide during the activity.

ART. 7 – CANCELLATION / INTERRUPTION BY THE CUSTOMER

7.1 Cancellation by the customer
- Cancellation of a reservation beyond 7 days: total refund of the deposit or online payment
- Cancellation of a reservation between 3 days and 7 days: the deposit is retained or 10% will be retained on the online payment

- Cancellation of a reservation between 3 days and 24 hours before the activity:   the deposit is retained or 30% will be retained on the online payment

- Cancellation of a reservation less than 24 hours before the activity: the deposit is kept or 50% will be retained on the online payment
Case of force majeure: in case of delays and upon presentation of proof, CPO  can reimburse the amount paid. In all cases, the customer agrees to notify CPO_cc781905-5cde-3194- bb3b-136bad5cf58d_of all notifications relating to the reservation: organization of the program, change in staff, delay or cancellation.

In case of absence, significant delay (more than 30 minutes) the entire deposit or online payment will be retained

7.2 – Interruption during the performance
In the event of an interruption during the service, the customer or participant cannot claim any refund.

ART. 8 – CANCELLATION / EXCLUSION BY CPO

8.1 – Cancellation

Some whitewater disciplines are dependent on EDF releases.
The monitors and they alone reserve the right to cancel or adapt the outing depending on water releases, weather conditions, levels or sporting abilities of the participants.
The activity may be canceled for security reasons or for any other case of force majeure. In this case, a replacement activity will be organized as far as possible or another date will be offered to you. If the exit cannot be carried out, the service is fully reimbursed without being able to claim any other compensation.
In the case of a cancellation by us due to an insufficient number of participants, the registered participants will be fully reimbursed and will not be able to claim any compensation.

8.2 – Disqualification
The instructors  reserve the right to exclude a participant who is intoxicated or whose behavior is likely to disturb the smooth running of the activity or compromise the safety of the group. In this case, the client or participant cannot claim any refund or compensation.

ART. 9 – APPOINTMENT
A time and a place of appointment are systematically communicated to you whatever the service. For the smooth running of the activities and out of respect for the other participants and the professional who supervises you, we kindly ask you to read the roadmaps and other indications previously transmitted by us. Be sure to anticipate your journeys so that you are punctual. We tolerate a delay of 15 minutes maximum. Beyond this period, the instructors leave for activities and no reimbursement or compensation will be payable.

ART. 10 – SUPERVISION OF YOUNG PEOPLE (MINORS):
Unaccompanied minors:
Minors under the age of 14 unaccompanied by an adult (legal guardian) are not accepted in so-called “collective” activities.
Unaccompanied minors aged 14 to 18 can be accepted in so-called "collective" activities, subject to parental authorization and under certain conditions (sporting level, skill, etc.)
In this case, parental authorization will be signed by the legal representative on the day of the activity.
Minors within the CVL / CLSH / School framework:
The organization organizing the stay or outing must be able to provide the monitor, for each participant (young person and leader)
-a 25-meter swimming certificate and the ability to immerse yourself,
- the health card of each participant.
The supervision of young minors is subject to regulations which limit it to 8 young people and 1 leader (maximum). Each group of minors must be accompanied by 2 adults including a center leader and the monitor supervising the activity.

ART. 11– GIFT VOUCHER
The gift voucher is effective upon receipt of the full amount of the service.
If the order form is nominative, it can be transmitted to the person of your choice provided you notify us in advance to modify the contact details of the new beneficiary.
The recipient of the gift voucher must contact us to book the outing.
The activity of the gift voucher can be replaced by another activity offered by CPO, provided that the value of the latter is equal to or less than the activity mentioned on the gift voucher. In the latter case, no refund of the difference can take place. On the other hand, it is possible to carry out an activity of a higher amount by paying the difference.
The gift voucher has an expiration date. After the period of validity (current year), the service will be considered as performed and cannot be postponed. The beneficiary and/or the buyer cannot claim any refund or compensation.
The gift voucher and the nominative document are to be presented on the day of the outing at the reception on the day of the session.
The outing will be guaranteed in the event that the minimum number of participants required is assured and in the event that the weather conditions allow the good practice of the activity.

 

ART. 12 – IMAGE RIGHTS
Photos of customers/participants may be taken during equipment and activities. Unless expressly mentioned by you, you authorize us to use these images for any purpose (commercial, advertising, cultural etc.), on any medium, and in the whole world.

Customers/participants agree to keep the photos purchased for personal use only and not to disclose them on any internet or other social network without the consent of the other participants/customers.

 

ART. 13 – Miscellaneous

Any modification of the legislation or regulations in force, or any decision of a competent court invalidating one or more clauses of the general conditions of sale could not affect the validity of the entirety of the general conditions of sale, the other stipulations of which will keep all their strength and reach. Such a modification or decision does not in any way authorize Customers to disregard these general conditions of sale.

The fact that CPO does not avail itself, at a given time, of any of the clauses of the Contract, cannot be interpreted as a waiver to avail itself of them later.

The general conditions of sale can be consulted on the Site and can be modified at any time at the discretion of CPO  without any other formality than their posting online, only the latest version will be applicable.

 

ART. 14 – SETTLEMENT OF DISPUTES
The parties will endeavor to resolve amicably any difficulties that may arise in the performance of the contract. If no amicable agreement could be reached, all disputes relating to the validity, interpretation and execution of this agreement will be governed exclusively by the rules of French law.
All disputes, of whatever nature, will fall within the jurisdiction of the French civil and commercial courts, including ruling in summary proceedings.
